Risk Prevention of Evidence Obtaining Procedure in Off-site Traffic Law Enforcement

In digital times, the electronic eyes have become the technic means of the off-site traffic law enforcement, which makes the procedure automated. According to the process theory, such enforcement can be divided into three stages: before, during and after. There exist certain risks in the evidence obtaining procedure in all these three stages, which are showed as the flaw of equipment setting in advance, inadequate public credibility of fixing evidence procedure in enforcement process, and weak protection of the relative person's rights to be informed and defended. The risk prevention can be done from the following aspects: standardization of equipment setting, improvement of public credibility of fixing evidence and protection of the relative person’s rights to be informed and defended. This may standardize the law enforcement procedure and realize the relative person’s procedure right.
