    Dual Value of Human Rights of the Right to Be Forgotten

    • The right to be forgotten (RBF) creates a tension between individual freedoms and security rights, and a dilemma by dual value of human rights arises. On one hand, RBF strives to protect individuals’ personal integrity, property, and mental well-being from infringement. On the other hand, it also respects the freedom of speech of information publishers and the public’s right to know. The dual value of human right can be addressed through the following three approaches. Firstly, a concept of digital justice is established to promote a deep integration of law and technology. Secondly, collective human rights are considered to reasonably safeguard freedom of speech and the public’s right to know. Thirdly, implementation measures are reinforced by specifying data types and applicable scenarios to enhance the possibility and accuracy of information removal. As a result, a balance between these two legal interests can be realized.
