On Formation of the Principle of No Harm to Foreign Environment: A Perspective of Trail Smelter and Corfu Channel Cases

摘要: “不损害国外环境责任原则”是国际环境法中的一项极其的重要原则,其内容最早出现在特雷尔冶炼厂案和科孚海峡案这两个著名案例之中。两案例在“不损害国外环境责任原则”国际习惯形成中的作用体现在:首先,他们是该项国际习惯的物质要素; 其次,他们将“禁止权力滥用原则”引入国际环境法,为之后的法律确信奠定了坚实的基础。Abstract: “No harm to foreign environment” is an extremely important principle of the international laws concerning environment. It appeared first in the two famous cases of Trail Smelter and Corfu Channel. The roles of the two cases in the formation of such principle lie in the following. First, they are the material elements in this international convention. Second, they introduced the ban of power abuse into the international laws concerning environment and lay the solid foundation for the legal confirmation.
